German Citizenship After 5 Years: The Standard Naturalization Route

Foreigners who have lived legally in Germany for five years can apply for German citizenship (Einbürgerung) under the standard naturalization provision.

Legal Basis

The right to naturalization after five years of lawful residence is codified in § 10 of the Nationality Act (Staatsangehörigkeitsgesetz – StAG). German law entitles you to citizenship once the conditions are met; the authority cannot arbitrarily refuse your application if you satisfy the statutory requirements.

Core Conditions

  • Five years of lawful residence in Germany. The period must be continuous and you must have resided in Germany legally.
  • A secured livelihood. You must have sufficient income to support yourself and any dependents without recourse to public assistance (Sozialhilfe, Bürgergeld).
  • B1 German language proficiency. This is a mandatory condition and cannot be waived, except for in exceptional circumstances.
  • Citizenship test certificate. You must generally pass a citizenship test.
  • No criminal record. Certain criminal convictions are grounds for refusal.
  • Commitment to the Constitution. You must acknowledge and accept the German Constitution (Grundgesetz).

Dual Citizenship

Since 2024, it is not necessary to renounce your current citizenship to be naturalized in Germany. However, your current country may not allow for dual citizenship.

The Application and Process

Applications are submitted to the Naturalization Office (Einbürgerungsbehörde) of your place of residence. Required documents include a valid passport, completed application form, proof of 5 years' residence, B1 language certificate, employment/income documentation, and criminal record certificate.

Do I lose my home country citizenship when I naturalize as German? That depends on the regulations of the country of which you are currently a citizen.

Can I apply before reaching the full five years? If you previously lived in Germany, are married to a German citizen, or are applying at the same time as a spouse who meets the five-year requirement, it is possible to apply for citizenship after three years.

What if I fail the language or citizenship test? You can retake them at any recognized testing center. There is no limit on retakes.
