Fiktionsbescheinigung: Proof of Pending Status in Germany (§ 81 AufenthG)
When you submit an application for a residence permit extension or a permit change at the immigration office before your current permit expires, your legal status does not end on the expiry date. Instead, the permit is treated as if it continues to be valid while the application is pending. This principle is called Fiktion, and the document proving this status is called a Fiktionsbescheinigung.
What Is a Fiktionsbescheinigung?
The Fiktionsbescheinigung (certificate of fictional validity) is an official document issued by the Ausländerbehörde confirming that your residence permit application is pending and that you retain lawful status in Germany under the fictional validity principle (Fiktion nach § 81 AufenthG).

The concept of fictional validity is enshrined in § 81 AufenthG: when an application for a residence permit is submitted while the current permit is still valid, the current permit is treated as continuing in force throughout the application process.
What Can You Do With a Fiktionsbescheinigung?
- Continue working, provided your current permit/visa allows you to work
- Remain in Germany and conduct all activities authorized under the permit you applied for
- Travel within the Schengen area (though leaving Germany carries risks) if your Fiktionsbescheinigung is issued under § 81 Abs. 4 AufenthG
- Prove to employers, landlords, and public authorities that you have a legal right to reside and work
