German Citizenship for Children: Automatic Acquisition & Naturalization

As of 2024, children born in Germany to foreign parents can now acquire German citizenship automatically under certain conditions.

Automatic Acquisition at Birth: The jus soli Rule (2024 Reform)

As of 27 June 2024, a child born in Germany automatically acquires German citizenship at birth if at least one parent has been lawfully resident in Germany for at least five years and possesses an unlimited right of residence (e.g., a Niederlassungserlaubnis). Children born to parents on temporary work permits do not automatically qualify.

Automatic Acquisition Through Descent (jus sanguinis)

A child born anywhere in the world automatically acquires German citizenship at birth if at least one parent is a German citizen at the time of birth. If that parent was born outside of Germany after 2000, the child only acquires German citizenship if it is registered with the German embassy within one year of birth.

Frequently Asked Questions

If I am a permanent resident and my child is born in Germany, is my child automatically German? If you have been living in Germany for at least five years at the time of birth, yes.

If I hold a work permit (even a Blue Card), is my child born in Germany automatically German? No. Work permits are time-limited. The rule applies only if the parent holds permanent residence. In some cases, permanent residence can be granted retroactively as long as the application was already submitted at the time of the child’s birth.
