Fiktionsbescheinigung: Your Rights While Your Permit Is Being Processed

Few German documents cause as much confusion as the Fiktionsbescheinigung — the "fictional certificate." It appears at one of the most anxious moments: your old permit has expired (or is about to), your new one is not ready, and you are left holding a slip of paper instead of a card.

What it is

A Fiktionsbescheinigung is a temporary certificate the Ausländerbehörde issues when you have applied for a residence permit (a first one or a renewal) but a decision is still pending. Applying for an extension/new permit before your current permit/visa expires means your current status is considered to remain valid until you receive a decision by the immigration office. The certificate confirms this legal status.

The crucial detail: which rights it carries

Not all Fiktionsbescheinigungen are equal. The certificate is issued under different legal provisions, and the provision cited on it determines your rights — particularly:

• Whether you may work. If your previous permit allowed work and you applied in time to renew, the certificate usually continues that right — but check the wording. A certificate issued in other circumstances may not permit employment.

• Whether you may travel. Re-entering Germany on a Fiktionsbescheinigung can be possible but is not guaranteed; combined with your passport and sometimes your old permit, it may allow return, but airlines can be cautious. Confirm before you book.

Always read the box/clause referenced on your certificate, and ask the office to clarify your work and travel rights in writing if you are unsure. Travel is also only possible with a Fiktionsbescheinigung issues per § 81 Abs. 4 AufenthG, not § 81 Abs. 3 AufenthG. This is an important distinction.

Why timing matters so much

The bridging effect generally depends on having applied for your permit before the old one expired. Apply late, and you may not get the protective certificate at all — which is why early renewal is so important.

• Assuming it always allows work — check the cited provision

• Travelling without confirming re-entry rights and getting stranded abroad

• Applying for renewal too late to qualify for the bridge

• Throwing away your old permit, which may be needed alongside the certificate

• Letting it expire without following up on your pending decision
