Permanent Residence for EU Blue Card Holders in Germany: § 18c Abs. 2 AufenthG

Overview

EU Blue Card holders in Germany can obtain a Niederlassungserlaubnis (permanent settlement permit) through an accelerated route under § 18c Abs. 2 Aufenthaltsgesetz (AufenthG). The standard qualifying period is 27 months; that period reduces to 21 months if the applicant has achieved B1-level German language proficiency.

Core Requirements

  • At least 27 months (or 21 months with B1 German) of lawful residence in Germany under the EU Blue Card.
  • Continued employment qualifying for the Blue Card, meeting the salary threshold applicable at the time of the Niederlassungserlaubnis application.
  • Contributions to the statutory pension scheme throughout the qualifying period.
  • B1 German language proficiency if applying after 21 months. If applying at the 27-month threshold, only A1 German language proficiency is necessary.
  • Basic knowledge of the legal and social system and the way of life in Germany
  • Adequate accommodation.

Pension Contributions: A Practical Note

The pension contribution requirement is often overlooked until the application stage. The Rentenversicherungsverlauf issued by Deutsche Rentenversicherung confirms the qualifying period; obtaining this in advance is strongly advisable.

Documents Required (non-exhaustive)

  • Valid passport and biometric photograph
  • Evidence of current Blue Card and lawful residence throughout the qualifying period
  • Current employment contract confirming the qualifying salary and employer confirmation
  • Rentenversicherungsverlauf confirming pension contributions
  • B1/A1 Language certificate
  • Citizenship test or similar proof of civic knowledge
  • Proof of adequate accommodation

Frequently Asked Questions

Does the 27-month period restart if I change employers? No. The period is based on continuous lawful Blue Card residence, not on employment with a specific employer.

What if I was on parental leave or sick leave during the qualifying period? Parental leave and statutory sick leave do not interrupt the qualifying period.
